If you run a business in India, employee injury protection is not simply a matter of buying an insurance policy. The legal framework depends on your establishment, employee strength, nature of work and whether your workers fall under the Employees’ State Insurance (ESI) Scheme.

The law commonly called the Workmen’s Compensation Act, 1923 was amended and renamed as the Employees’ Compensation Act, 1923 in 2010. A key distinction is that an employee covered under the ESI Act for an employment injury is generally dealt with under the ESI framework rather than through a parallel compensation claim under the Employees’ Compensation Act.

When Does ESI Apply to Your Business?

Before we discuss WC policy applicability in India, let’s first understand ESI applicablity:

Coverage Threshold

ESI generally applies to factories and notified establishments employing 10 or more persons. The scheme has been extended to several categories, including shops, hotels, restaurants, road motor transport undertakings, newspaper establishments, educational institutions and private medical institutions, subject to the applicable notifications and geographical coverage. The exact position can vary by State, Union Territory and category of establishment.

For a business owner, counting only permanent staff can be a mistake. Depending on the facts of employment and the establishment, workers engaged through contractors or on other employment arrangements may also become relevant for compliance.

Wage Ceiling

The present ESI wage ceiling is ₹21,000 per month. For persons with disabilities, the ceiling is ₹25,000 per month. The wage ceiling has remained at ₹21,000 since the revision effective from 1 January 2017.

However, you should not assume that an employee immediately exits the scheme the moment their wages cross the ceiling. The ESI Act contains continuation rules linked to the contribution period. Your payroll and HR team should therefore check the applicable contribution-period rules before stopping deductions or coverage.

Business Continuity

Once an establishment becomes covered under the ESI Act, coverage does not automatically disappear merely because the employee count subsequently falls below the prescribed threshold. This is particularly important for seasonal fluctuations, restructuring and temporary reductions in manpower.

When Does the Employees’ Compensation Act Apply? 

If you are looking at the applicability of the Employees’ Compensation Act, here’s what you need to know:

Worker Categories

The Employees’ Compensation Act, 1923 primarily creates employer liability where an employee suffers an injury arising out of and in the course of employment. It also covers specified occupational diseases. Its coverage is especially relevant to categories listed in Schedule II and includes workers in areas such as factories, mines, plantations, mechanically propelled vehicles, and construction work, along with other specified or hazardous occupations.

State governments can also extend coverage to additional hazardous occupations in accordance with the Act. This means a small construction contractor, transport operator or industrial employer cannot assume that having fewer than 10 workers removes all statutory injury-compensation obligations.

Employment Connection

For employer liability under the WC Act to arise, the injury generally needs to have a sufficient connection with employment and occur in the course of employment. The Act can cover:

  • Death resulting from a work-related accident
  • Permanent total disablement
  • Permanent partial disablement
  • Temporary disablement
  • Specified occupational diseases

Compensation Amount

The Employees’ Compensation Act does not provide a single flat payout for every accident. Compensation is calculated using the statutory formula applicable to the type of injury. The Labour Bureau’s report notes that the statutory wage ceiling used for calculating compensation was increased to ₹15,000 per month with effect from 3 January 2021. The minimum compensation figures cited for death and permanent total disablement are ₹1.20 lakh and ₹1.40 lakh, respectively.

The actual liability can be significantly different depending on the employee’s age, wages and disability assessment.

Payment Delays

The employer’s liability is also time-sensitive. Delayed payment of compensation can result in interest and penalties under the Act. A labour authority may intervene in disputed cases and enforcement proceedings.

For employers, this makes accident documentation important. You should maintain records of the incident, employment details, wages, medical findings and communication with the employee or dependants.

Which Law Applies to Your Business?

Here is which law applies to your business:

Small Business

Suppose you operate a construction business with eight workers. Your employee count may be below the usual ESI threshold, but that does not automatically eliminate your responsibility under the Employees’ Compensation Act if your workers fall within its scope and suffer a qualifying employment-related injury.

In this situation, reviewing compensation liability and arranging suitable insurance cover can be commercially important.

Covered Establishment

Now consider a manufacturing unit with 25 employees in an ESI-covered area, where several employees earn below ₹21,000 per month. The establishment may fall within the ESI framework, and eligible employees must be covered accordingly.

For employment injuries involving insured employees, the ESI framework becomes central. The Employees’ Compensation Act itself excludes workers covered under the ESI Act from parallel coverage under that Act.

Mixed Workforce

Many Indian businesses have a mixed workforce. You may have employees who are ESI-covered and others who are outside the ESI wage ceiling. You may also use contractors for security, housekeeping, construction, logistics or maintenance.

Do not assume that one compliance framework applies uniformly to every person working at your premises. Review:

  1. Whether your establishment is covered under ESI
  2. The category and location of your establishment
  3. Your total employee strength
  4. Each worker’s wages and contribution status
  5. The worker’s employment arrangement
  6. Whether the work falls within the scope of the Employees’ Compensation Act

Conclusion

For most businesses, ESI is not an alternative you can voluntarily choose over the Employees’ Compensation Act. The applicable law depends on your establishment and workforce.

If your business and employees fall within ESI coverage, you must follow the ESI framework and provide statutory coverage through the scheme. If ESI does not apply to a worker, your business may still face liability under the Employees’ Compensation Act, particularly in specified employment categories and hazardous occupations.
